width=\u00a0\u00bb1\/1&Prime; tablet_width_inherit=\u00a0\u00bbdefault\u00a0\u00bb tablet_text_alignment=\u00a0\u00bbdefault\u00a0\u00bb phone_text_alignment=\u00a0\u00bbdefault\u00a0\u00bb bg_image_animation=\u00a0\u00bbnone\u00a0\u00bb border_type=\u00a0\u00bbsimple\u00a0\u00bb column_border_width=\u00a0\u00bbnone\u00a0\u00bb column_border_style=\u00a0\u00bbsolid\u00a0\u00bb][divider line_type=\u00a0\u00bbNo Line\u00a0\u00bb custom_height=\u00a0\u00bb30&Prime;][vc_column_text]\n<div class=\"entry-meta\">\n<p><span class=\"posted-on\"><time class=\"entry-date published\" datetime=\"2016-06-20T14:22:06-04:00\">20 juin 2016<\/time><\/span><\/p>\n<\/div>\n<div class=\"shapely-content \">\n<p class=\"p1\"><span class=\"s1\">L&rsquo;ACLC soutient le d\u00e9p\u00f4t du <strong><a href=\"http:\/\/www.parl.gc.ca\/HousePublications\/Publication.aspx?Language=E&#038;Mode=1&#038;DocId=8375614\" target=\"_blank\" rel=\"noopener\">projet de loi C-22<\/a><\/strong>, qui cr\u00e9e un Comit\u00e9 parlementaire de la s\u00e9curit\u00e9 nationale et du renseignement habilit\u00e9 \u00e0 surveiller les activit\u00e9s classifi\u00e9es en mati\u00e8re de s\u00e9curit\u00e9 et de renseignement et \u00e0 rendre compte de ses conclusions au premier ministre.  <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Ce nouveau m\u00e9canisme de responsabilisation est essentiel car, jusqu\u2019\u00e0 pr\u00e9sent, les vastes pouvoirs accord\u00e9s \u00e0 l\u2019\u00c9tat par le projet de loi C-51 n\u2019\u00e9taient assortis d\u2019aucune obligation de rendre compte \u00e0 la hauteur de ces pouvoirs. Nous notons \u00e9galement que le Comit\u00e9 aura le pouvoir de surveiller les activit\u00e9s de l\u2019Agence des services frontaliers du Canada (ASFC). Contrairement \u00e0 la GRC, au SCRS et au CST, l\u2019ASFC n\u2019a jusqu\u2019\u00e0 pr\u00e9sent fait l\u2019objet d\u2019aucune surveillance, bien que 14 personnes soient d\u00e9c\u00e9d\u00e9es alors qu\u2019elles \u00e9taient sous sa garde (ou celle de ses organismes pr\u00e9d\u00e9cesseurs).    <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Nous estimons toutefois que certains \u00e9l\u00e9ments cl\u00e9s du projet de loi C-22 doivent \u00eatre examin\u00e9s avec soin et, le cas \u00e9ch\u00e9ant, modifi\u00e9s. Tout d\u2019abord, nous sommes pr\u00e9occup\u00e9s par le pouvoir dont dispose le gouvernement de mettre fin \u00e0 une enqu\u00eate du Comit\u00e9 ou de refuser de fournir des informations lorsqu\u2019il estime que cela est \u00ab pr\u00e9judiciable \u00e0 la s\u00e9curit\u00e9 nationale \u00bb. Bien que nous reconnaissions que le plus grand secret est parfois n\u00e9cessaire, cela est particuli\u00e8rement inqui\u00e9tant car ces d\u00e9cisions sont d\u00e9finitives et ne sont soumises \u00e0 aucun contr\u00f4le judiciaire ni \u00e0 aucun autre processus de r\u00e8glement des diff\u00e9rends. Tout aussi pr\u00e9occupant est le pouvoir du premier ministre de caviarder les rapports du comit\u00e9 (sans aucune preuve que des caviardages ont \u00e9t\u00e9 effectu\u00e9s), ainsi que les nombreuses cat\u00e9gories d\u2019informations auxquelles le comit\u00e9 n\u2019a pas acc\u00e8s. De plus, ce sont les membres du comit\u00e9 eux-m\u00eames \u2014 et non le premier ministre \u2014 qui devraient choisir le pr\u00e9sident du comit\u00e9.      <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Avant tout, il est important de noter que ce m\u00e9canisme \u00e0 lui seul \u2014 ainsi que les autres promesses contenues dans le programme \u00e9lectoral du Parti lib\u00e9ral \u2014 ne permet pas de r\u00e9parer enti\u00e8rement les dommages caus\u00e9s par le projet de loi C-51. Il convient notamment de noter qu\u2019il n\u2019y a toujours pas d\u2019intention d\u00e9clar\u00e9e d\u2019\u00e9liminer les nouveaux pouvoirs \u00e9tendus du gouvernement en mati\u00e8re de partage d\u2019informations, ni les modifications pr\u00e9occupantes apport\u00e9es \u00e0 la <i>Loi sur l\u2019immigration et la protection des r\u00e9fugi\u00e9s \u2014 deux <\/i>mesures que nous contestons devant les tribunaux.   <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Des m\u00e9canismes de responsabilisation solides et efficaces sont essentiels pour les organismes de s\u00e9curit\u00e9 et de renseignement. En l\u2019absence de tels m\u00e9canismes, ces organismes risquent de porter atteinte aux droits et libert\u00e9s des personnes au Canada, ce qui peut entra\u00eener de graves violations des droits et menacer, par la m\u00eame occasion, les fondements m\u00eames de la d\u00e9mocratie canadienne. L\u2019ACLC s\u2019est battue pour la responsabilisation en mati\u00e8re de s\u00e9curit\u00e9 nationale en <strong><a href=\"https:\/\/staging.ccla.org\/wp-content\/uploads\/2021\/06\/CCLA-Senate-Committee-20-04-15.pdf\" target=\"_blank\" rel=\"noopener\">des m\u00e9moires adress\u00e9s au Comit\u00e9 s\u00e9natorial de la s\u00e9curit\u00e9 nationale et de la d\u00e9fense<\/a><\/strong>,<strong> <\/strong><\/span><span class=\"s1\">ainsi que dans notre <strong><a href=\"https:\/\/staging.ccla.org\/wp-content\/uploads\/2021\/06\/Issued-Notice-of-Application-Bill-C-51-C1383715xA0E3A-1.pdf\" target=\"_blank\" rel=\"noopener\">recours en vertu de la Charte contre le projet de loi C-51<\/a><\/strong>.
