Bien que le projet de loi C-59 apporte des am\u00e9liorations notables au paysage de la s\u00e9curit\u00e9 nationale canadienne, il ne parvient pas non plus \u00e0 r\u00e9soudre un certain nombre de probl\u00e8mes graves cr\u00e9\u00e9s ou exacerb\u00e9s par la <a href=\"http:\/\/laws-lois.justice.gc.ca\/eng\/AnnualStatutes\/2015_20\/\" target=\"_blank\" rel=\"noopener\"><em>Loi antiterroriste de 2015<\/em><\/a>. De plus, il introduit de nouvelles dispositions susceptibles de compromettre ou de porter atteinte aux protections constitutionnelles garanties par la <em>Charte<\/em> <em>canadienne<\/em> <em>des droits et libert\u00e9s<\/em>.  <\/p>\n<p>\u00c0 notre avis, de nombreux aspects du projet de loi C-59 n\u00e9cessitent des modifications importantes, tant pour r\u00e9sister \u00e0 un examen constitutionnel que pour prot\u00e9ger de mani\u00e8re ad\u00e9quate les droits et la s\u00e9curit\u00e9 de toutes les personnes au Canada. Ce projet de loi constitue la tentative la plus compl\u00e8te de modernisation de la l\u00e9gislation canadienne en mati\u00e8re de s\u00e9curit\u00e9 nationale depuis trente ans. Ne pas r\u00e9soudre ces probl\u00e8mes cruciaux de longue date est une occasion que le Canada ne peut se permettre de laisser passer.  <\/p>\n<p>Le nouveau projet <em>de loi sur l&rsquo;Agence de contr\u00f4le de la s\u00e9curit\u00e9 nationale et du renseignement<\/em> ainsi que le projet de loi sur le commissaire au renseignement visent tous deux \u00e0 mettre en place de nouvelles mesures de responsabilisation afin d&rsquo;assurer le contr\u00f4le et la surveillance des organismes charg\u00e9s de la s\u00e9curit\u00e9 nationale. Nos recommandations ont pour objectif de renforcer ces nouvelles instances et de combler les lacunes importantes du cadre propos\u00e9. <\/p>\n<p>Le projet <em>de loi sur le Centre de la s\u00e9curit\u00e9 des t\u00e9l\u00e9communications<\/em>\u2014 une nouvelle loi habilitante pour le CST \u2014 est le bienvenu. Nos recommandations portent principalement sur les pr\u00e9occupations li\u00e9es au nouveau volet du mandat du CST concernant les op\u00e9rations cyberactives, \u00e0 la d\u00e9finition tr\u00e8s large de l\u2019\u00ab information accessible au public \u00bb et aux lacunes en mati\u00e8re de contr\u00f4le et de compte rendu des activit\u00e9s du CST. <\/p>\n<p>Le projet de loi C-59 maintient les pouvoirs de r\u00e9duction des menaces pr\u00e9vus par la <em>Loi sur le Service canadien du renseignement de s\u00e9curit\u00e9<\/em>, tout en instaurant un nouveau r\u00e9gime de gestion des ensembles de donn\u00e9es pour le SCRS. Nos recommandations visent \u00e0 garantir l\u2019<br \/>\n, que les ensembles de donn\u00e9es soient collect\u00e9s dans le cadre du mandat du SCRS et que des m\u00e9canismes ad\u00e9quats de tenue des dossiers et de reddition de comptes soient en place. L\u2019ACLC continue de s\u2019interroger sur la question de savoir si la n\u00e9cessit\u00e9 de pouvoirs d\u2019<br \/>\nen mati\u00e8re de r\u00e9duction des menaces a \u00e9t\u00e9 d\u00e9montr\u00e9e, mais reconna\u00eet les am\u00e9liorations apport\u00e9es au dispositif initialement \u00e9tabli par le projet de loi C-51.  <\/p>\n<p>Le projet de loi C-59 propose des modifications importantes \u00e0 la <em>loi<\/em> controvers\u00e9e <em>sur le partage de renseignements pour la s\u00e9curit\u00e9 du Canada<\/em> (SCISA), mais celles-ci ne suffisent pas \u00e0 rem\u00e9dier aux probl\u00e8mes mis en \u00e9vidence lors de la pr\u00e9sentation du projet de loi C-51 et lors de l&rsquo;examen qui a suivi. Nos recommandations proposent des modifications concernant le d\u00e9clencheur de la divulgation ainsi que les seuils de divulgation et de conservation. Nous abordons \u00e9galement les lacunes d\u2019<br \/>\ns dans les mesures de responsabilisation et la n\u00e9cessit\u00e9 de clarifier l\u2019interaction entre la SCISA et la Loi sur la protection des renseignements personnels.  <\/p>\n<p>Les graves lacunes proc\u00e9durales de la <em>loi sur la s\u00e9curit\u00e9 des transports a\u00e9riens (Secure Air Travel Act)<\/em>, qui peuvent avoir des cons\u00e9quences d\u00e9sastreuses sur la vie de personnes innocentes, n\u2019ont pas \u00e9t\u00e9 corrig\u00e9es de mani\u00e8re ad\u00e9quate. Nos recommandations, pr\u00e9sent\u00e9es dans le document \u00ab<br \/>\n\u00bb, visent \u00e0 relever le seuil d\u2019inscription sur la liste et \u00e0 am\u00e9liorer le dispositif de recours dont disposent les personnes souhaitant contester leur inscription sur cette liste. <\/p>\n<p>En ce qui concerne les modifications apport\u00e9es <em>au Code criminel<\/em>, nous formulons des recommandations sur des questions allant de la liste des entit\u00e9s terroristes aux dispositions relatives aux discours et \u00e0 la propagande terroristes, en passant par celles concernant les engagements de ne pas troubler l&rsquo;ordre public et les arrestations sans mandat. Dans chaque cas, notre souci est de veiller \u00e0 ce que le droit p\u00e9nal soit appliqu\u00e9 de mani\u00e8re \u00e0 pr\u00e9venir les menaces terroristes, tout en respectant les droits fondamentaux garantis par la Charte d&rsquo;<br \/>\n. <\/p>\n<p>Enfin, \u00e9tant donn\u00e9 que le Comit\u00e9 peut proposer des amendements qui sortent du champ d&rsquo;application actuel du projet de loi, nous recommandons que les modifications apport\u00e9es \u00e0 la Loi sur l&rsquo;immigration et la protection des r\u00e9fugi\u00e9s<br \/>\npar le projet de loi C-51 soient abrog\u00e9es.
