Archie Campbell, Commission sur le SARS, 2007. <\/p>\n<p><span data-contrast=\"auto\">Il existe deux types de l\u00e9gislation en mati\u00e8re de gestion des urgences : celle qui a \u00e9t\u00e9 adopt\u00e9e <\/span><em><span data-contrast=\"auto\">apr\u00e8s<\/span><\/em><span data-contrast=\"auto\"> la fin d\u2019une crise, et celles adopt\u00e9es en pleine crise. <\/span><span data-contrast=\"auto\">Le gouvernement f\u00e9d\u00e9ral a adopt\u00e9 la premi\u00e8re cat\u00e9gorie apr\u00e8s la crise d\u2019octobre 1970. La Colombie-Britannique \u00e9tait en train de mettre \u00e0 jour sa l\u00e9gislation de 1993 avant la pand\u00e9mie de COVID, et <\/span><span data-contrast=\"auto\">l\u2019Ontario <\/span><span data-contrast=\"auto\">a \u00e9galement mis \u00e0 jour ses lois d\u2019urgence<\/span><span data-contrast=\"auto\">\u00e0 plusieurs reprises apr\u00e8s le SRAS, entre 2006 et 2019<\/span><span data-contrast=\"auto\">. <\/span> <span data-ccp-props=\"{\"> <\/span><\/p>\n<p><span data-contrast=\"auto\">Nous assistons aujourd&rsquo;hui, au Canada, \u00e0 l&rsquo;autre type<\/span><span data-contrast=\"auto\">.<\/span><span data-contrast=\"auto\"> L&rsquo;Alberta <\/span><span data-contrast=\"auto\">et le Manitoba <\/span><span data-contrast=\"auto\">l\u2019ont fait <\/span><span data-contrast=\"auto\">le mois dernier<\/span><span data-contrast=\"auto\">, puis <\/span><span data-contrast=\"auto\">Terre-Neuve, et maintenant l\u2019\u00cele-du-Prince-\u00c9douard a mis en ligne son propre projet de loi sur la gestion des urgences. <\/span> <span data-ccp-props=\"{\"> <\/span><\/p>\n<p><span data-contrast=\"auto\">Le<\/span><span data-contrast=\"auto\"> probl\u00e8me<\/span><span data-contrast=\"auto\"> <\/span><span data-contrast=\"auto\">Le probl\u00e8me avec le fait de l\u00e9gif\u00e9rer en p\u00e9riode de crise, lorsque cette l\u00e9gislation implique la cr\u00e9ation de nouveaux pouvoirs pour le gouvernement, c&rsquo;est que tout cela finit par ressembler au <\/span><span data-contrast=\"auto\">tristement c\u00e9l\u00e8bre <\/span><span data-contrast=\"auto\">Patriot Act am\u00e9ricain. En d\u2019autres termes, c\u2019est toujours une mauvaise nouvelle pour vos droits humains.<\/span><span data-contrast=\"auto\"> Les gouvernements s\u2019accaparent de nouveaux pouvoirs pour porter atteinte aux droits individuels au nom de la crise ; ce sont toujours les plus vuln\u00e9rables qui en paient le prix le plus lourd, et l\u2019histoire n\u2019en retient que des regrets. <\/span><span data-contrast=\"auto\">L&rsquo;\u00e9galit\u00e9, la libert\u00e9 d&rsquo;expression, le respect des proc\u00e9dures l\u00e9gales et la libert\u00e9 passent toutes au second plan face \u00e0 la volont\u00e9 collective de repousser <\/span><span data-contrast=\"auto\">un ennemi<\/span><span data-contrast=\"auto\"> , qu\u2019il soit humain ou viral. C\u2019est comme changer les r\u00e8gles en plein milieu des phases finales \u2013 ce n\u2019est jamais une bonne id\u00e9e.<\/span><\/p>\n<p><span data-contrast=\"auto\">Cela s&rsquo;explique par plusieurs raisons, mais la plus \u00e9vidente est que les gouvernements <\/span><span data-contrast=\"auto\">qui r\u00e9digent un tel projet de loi <\/span><span data-contrast=\"auto\">le font en disposant d\u2019informations terriblement insuffisantes<\/span><span data-contrast=\"auto\">et sous une pression personnelle et politique \u00e9norme<\/span><span data-contrast=\"auto\">. Ils se trouvent litt\u00e9ralement dans l\u2019\u0153il du cyclone, ce qui affecte \u00e9videmment tous les aspects de la l\u00e9gislation. <\/span><span data-contrast=\"auto\">Les informations <\/span><span data-contrast=\"auto\">s&rsquo;av\u00e8rent<\/span><span data-contrast=\"auto\"> incompl\u00e8tes <\/span><span data-contrast=\"auto\">et<\/span><span data-contrast=\"auto\"> erron\u00e9es. Si l\u2019Ontario avait r\u00e9dig\u00e9 un <\/span><span data-contrast=\"auto\">nouvelle <\/span><span data-contrast=\"auto\">loi en mars, <\/span><span data-contrast=\"auto\">par exemple, <\/span><span data-contrast=\"auto\">les masques chirurgicaux auraient \u00e9t\u00e9 interdits \u00e0 tous, sauf aux professionnels de la sant\u00e9. Le papier hygi\u00e9nique aurait \u00e9t\u00e9 rationn\u00e9, en vertu de la loi. Aujourd\u2019hui, la situation est tout autre<\/span><span data-contrast=\"auto\">, le gouvernement a donc eu raison de ne pas modifier ses lois.<\/span><span data-ccp-props=\"{}\"> <\/span><\/p>\n<p><span data-contrast=\"auto\">Outre le manque d&rsquo;informations, <\/span><span data-contrast=\"auto\">il y a <\/span><span data-contrast=\"auto\">un<\/span><span data-contrast=\"auto\"> d\u00e9ficit de sagesse. <\/span><span data-contrast=\"auto\">Les lois sont<\/span><span data-contrast=\"auto\"> r\u00e9dig\u00e9es par des \u00eatres humains, apr\u00e8s tout<\/span><span data-contrast=\"auto\">, <\/span><span data-contrast=\"auto\">qui sont extr\u00eamement inquiets face \u00e0 la crise qu\u2019ils tentent de g\u00e9rer, en tant que dirigeants d\u00e9mocratiques. C\u2019est ce qu\u2019on appelle le \u00ab brouillard de la guerre \u00bb, un terme invent\u00e9 par Robert McNamara, en guise d\u2019autocritique de ce que lui-m\u00eame et deux pr\u00e9sidents ont fait en g\u00e9rant mal la guerre du Vietnam. <\/span> <span data-ccp-props=\"{\"> <\/span><\/p>\n<p><span data-contrast=\"auto\">La sagesse exige du temps et du recul ; de la s\u00e9r\u00e9nit\u00e9 et de la patience ; de l&rsquo;intelligence et de la r\u00e9flexion. <\/span><span data-contrast=\"auto\">Le brouillard de la guerre <\/span><span data-contrast=\"auto\">enveloppe les l\u00e9gislateurs<\/span><span data-contrast=\"auto\"> <\/span><span data-contrast=\"auto\">crainte<\/span><span data-contrast=\"auto\"> et l\u2019incertitude<\/span><span data-contrast=\"auto\">. La l\u00e9gislation, en revanche, exige de la certitude. Si elle est floue ou vague, c\u2019est alors une mauvaise loi, susceptible de faire l\u2019objet d\u2019un contr\u00f4le juridictionnel par <\/span><span data-contrast=\"auto\">des organisations d\u2019int\u00e9r\u00eat public <\/span><span data-contrast=\"auto\">telles que la n\u00f4tre, l\u2019Association canadienne des libert\u00e9s civiles. <\/span><span data-contrast=\"auto\">Sachant cela, les gouvernements r\u00e9digent des lois avec une certitude \u00e0 toute \u00e9preuve, m\u00eame si elles reposent sur des faits flous. <\/span> <span data-ccp-props=\"{\"> <\/span><\/p>\n<p><span data-contrast=\"auto\">Les projets de loi du gouvernement sont ensuite transmis \u00e0 l&rsquo;assembl\u00e9e l\u00e9gislative, o\u00f9 ils sont cens\u00e9s \u00eatre <\/span><span data-contrast=\"auto\">am\u00e9lior\u00e9s par le d\u00e9bat d\u00e9mocratique, la contestation et un examen minutieux. <\/span><span data-contrast=\"auto\">Or, que pensez-vous qu\u2019il advienne de <\/span><span data-contrast=\"auto\">ce <\/span><span data-contrast=\"auto\">d\u00e9bat en cas d\u2019urgence<\/span><span data-contrast=\"auto\">?<\/span><span data-contrast=\"auto\"> Imaginez que vous soyez dans votre cuisine, avec votre famille <\/span><span data-contrast=\"auto\">et vos amis<\/span><span data-contrast=\"auto\">, en train de discuter de ce qu\u2019il faut faire face \u00e0 cette <\/span><span data-contrast=\"auto\">odeur <\/span><span data-contrast=\"auto\">qui est partout mais ne provient pas du four. Ce d\u00e9bat est-il vraiment constructif ? <\/span> <span data-ccp-props=\"{\"> <\/span><\/p>\n<p><span data-contrast=\"auto\">Ce genre de raisonnement permet \u00e0 l&rsquo;homo sapiens d&rsquo;\u00e9chapper au danger. Mais cela ne constitue pas une bonne <\/span><span data-contrast=\"auto\">l\u00e9gislation<\/span><span data-contrast=\"auto\">. <\/span><span data-contrast=\"auto\">En fait, j\u2019avais <\/span><span data-contrast=\"auto\">un <\/span><span data-contrast=\"auto\">d\u00e9put\u00e9 provincial <\/span><span data-contrast=\"auto\">d\u00e9put\u00e9 provincial et ministre du Cabinet<\/span><span data-contrast=\"auto\"> <\/span><span data-contrast=\"auto\">en 2006 <\/span><span data-contrast=\"auto\">lorsque le gouvernement lib\u00e9ral a suivi les <\/span><span data-contrast=\"auto\">recommandations de la Commission sur le SRAS pr\u00e9sid\u00e9e par Archie Campbell<\/span><span data-contrast=\"auto\">. Elle avait \u00e9t\u00e9<\/span> <span data-contrast=\"auto\"> convoqu\u00e9e par le premier ministre Ernie <\/span><span data-contrast=\"auto\">Eves <\/span><span data-contrast=\"auto\">en 2003 apr\u00e8s que <\/span><span data-contrast=\"auto\">l\u2019Ontario ait surmont\u00e9 la crise du SRAS sans disposer de pouvoirs l\u00e9gaux d\u2019urgence explicites<\/span><span data-contrast=\"auto\">. Ainsi, <\/span> <span data-contrast=\"auto\">l&rsquo;Ontario <\/span><span data-contrast=\"auto\">a par la suite <\/span><span data-contrast=\"auto\">mis \u00e0 jour ces lois pour leur donner leur forme actuelle \u2013 encore imparfaites, incapables de pr\u00e9voir ce qui serait n\u00e9cessaire pour la COVID, mais ayant tir\u00e9 les le\u00e7ons du pass\u00e9. Le d\u00e9bat n\u2019a pas \u00e9t\u00e9 pr\u00e9cipit\u00e9 et a inclus des amendements propos\u00e9s par le NPD et les conservateurs. <\/span> <span data-contrast=\"auto\">Le fait est que cela n\u2019a pas \u00e9t\u00e9 fait dans le brouillard d\u2019une crise, <\/span><span data-contrast=\"auto\">mais avec le luxe fortuit de disposer de temps<\/span><span data-contrast=\"auto\"> pour y r\u00e9fl\u00e9chir<\/span><span data-contrast=\"auto\">, de d\u00e9battre et de modifier les lois<\/span><span data-contrast=\"auto\"> du mieux <\/span><span data-contrast=\"auto\">pouvait<\/span><span data-contrast=\"auto\"> pouvait. <\/span>    <span data-ccp-props=\"{\"> <\/span><\/p>\n<p><span data-contrast=\"auto\">Les chances de voir s&rsquo;instaurer un d\u00e9bat d\u00e9mocratique sain en p\u00e9riode de crise sont pratiquement nulles \u2013 surtout aujourd&rsquo;hui, alors que les assembl\u00e9es l\u00e9gislatives ne comptent qu&rsquo;une fraction de leurs membres, afin de garantir une distance physique suffisante entre les \u00e9lus. S&rsquo;opposer \u00e0 un tel projet de loi, ou pire encore, en retarder l&rsquo;adoption, revient \u00e0 commettre un acte de trahison. <\/span><span data-contrast=\"auto\">Mieux vaut que les gouvernements gouvernent avec les pouvoirs dont ils disposaient au d\u00e9but de la crise, plut\u00f4t que de remanier les lois sur la gestion des urgences dans le brouillard.
