et non pas <\/span><em>apr\u00e8s<\/em><span data-contrast=\"auto\">. Cela signifie que les fruits d&rsquo;une recherche ne peuvent pas \u00eatre utilis\u00e9s pour justifier une violation d\u00e9raisonnable de la vie priv\u00e9e. Cet argument \u00e9tait au c\u0153ur de l&rsquo;intervention de l&rsquo;ACLC devant la Cour supr\u00eame du Canada (CSC) dans l&rsquo;affaire <\/span><em>York Region District School Board c. Elementary Teachers&rsquo; Federation of Ontario<\/em><span data-contrast=\"auto\">.<\/span><span data-ccp-props=\"{}\"> <\/span><\/p>\n<p><span data-contrast=\"auto\">Plus t\u00f4t aujourd&rsquo;hui, la CSC a confirm\u00e9 que les enseignants des conseils scolaires publics de l&rsquo;Ontario sont prot\u00e9g\u00e9s par l&rsquo;article 8 de la Loi sur l&rsquo;\u00e9ducation.   <\/span><em>Charte<\/em> <span data-contrast=\"auto\">sur le lieu de travail. La d\u00e9cision majoritaire a \u00e9galement estim\u00e9 que l&rsquo;\u00e9valuation de l&rsquo;existence d&rsquo;une attente raisonnable en mati\u00e8re de respect de la vie priv\u00e9e au moment de la fouille devait \u00eatre neutre sur le plan du contenu. La d\u00e9cision minoritaire a d\u00e9velopp\u00e9 cette conclusion, expliquant que l&rsquo;\u00e9valuation de l&rsquo;attente raisonnable de respect de la vie priv\u00e9e des enseignants ne d\u00e9pendait pas de ce qui se trouvait dans les locaux de l&rsquo;\u00e9cole. <\/span> <em>effectivement<\/em><span data-contrast=\"auto\"> trouv\u00e9. Ce qui importait, c&rsquo;\u00e9tait le <\/span> <em>potentiel<\/em><span data-contrast=\"auto\"> que la recherche puisse r\u00e9v\u00e9ler des informations touchant au noyau biographique des enseignants. Cela va dans le sens des observations faites par l&rsquo;ACLC en tant qu&rsquo;intervenant dans cette affaire. S&rsquo;il en \u00e9tait autrement, les acteurs gouvernementaux tels que les conseils scolaires seraient encourag\u00e9s \u00e0 lire un journal ou une conversation avant de se demander ce qu&rsquo;ils doivent faire pour respecter le droit \u00e0 la vie priv\u00e9e de leurs employ\u00e9s.<\/span>  <span data-ccp-props=\"{}\"> <\/span><\/p>\n<p><span data-contrast=\"auto\">La d\u00e9cision minoritaire a \u00e9galement fait \u00e9cho aux observations de l&rsquo;ACLC sur la n\u00e9cessit\u00e9 d&rsquo;adopter une approche large et flexible de ce qui constitue une communication priv\u00e9e afin de suivre les d\u00e9veloppements technologiques et les nouvelles formes de communication. La d\u00e9cision minoritaire a soutenu que les informations contenues dans les appareils connect\u00e9s \u00e0 Internet tendent normativement \u00e0 r\u00e9v\u00e9ler les int\u00e9r\u00eats, les go\u00fbts et les propensions sp\u00e9cifiques d&rsquo;une personne, et qu&rsquo;elles sont donc au c\u0153ur m\u00eame du noyau biographique prot\u00e9g\u00e9 par l&rsquo;art.  8. La majorit\u00e9 n&rsquo;a pas abord\u00e9 directement cette question.<\/span><span data-ccp-props=\"{}\"> <\/span><\/p>\n<p><span data-contrast=\"auto\">Cet appel fait suite \u00e0 une d\u00e9cision de la Cour d&rsquo;appel de l&rsquo;Ontario selon laquelle un directeur du York Region District School Board (Board) a proc\u00e9d\u00e9 \u00e0 une fouille et \u00e0 une saisie ill\u00e9gales de l&rsquo;ordinateur portable d&rsquo;un enseignant lorsqu&rsquo;il a acc\u00e9d\u00e9 aux communications priv\u00e9es de deux enseignants, les a lues et a fait des captures d&rsquo;\u00e9cran de ces communications. Les captures d&rsquo;\u00e9cran de ces communications enregistr\u00e9es dans leur journal personnel, prot\u00e9g\u00e9 par mot de passe et stock\u00e9 dans le nuage, ont \u00e9t\u00e9 utilis\u00e9es dans le cadre de proc\u00e9dures disciplinaires \u00e0 l&rsquo;encontre des deux enseignants. Le syndicat a d\u00e9pos\u00e9 un grief pour violation du droit \u00e0 la vie priv\u00e9e des enseignants par la Commission. L&rsquo;arbitre a rejet\u00e9 le grief, et la majorit\u00e9 de la Cour divisionnaire a confirm\u00e9 cette d\u00e9cision et rejet\u00e9 la demande de contr\u00f4le judiciaire.   <\/span><span data-ccp-props=\"{}\"> <\/span><\/p>\n<p><span data-contrast=\"auto\">L&rsquo;ACLC se r\u00e9jouit du renforcement par la CSC des principes bien \u00e9tablis de l&rsquo;article 8. Parce que ces principes sont fondamentaux dans la fa\u00e7on dont nous concevons la protection de la vie priv\u00e9e en vertu de l&rsquo;article 8, leur impact se fera sentir au-del\u00e0 du contexte du conseil scolaire et plus largement dans tous les cas qui mettent en jeu le droit \u00e0 la vie priv\u00e9e en vertu de l&rsquo;article 8 de la <\/span><em>Charte<\/em><span
