width=\u00a0\u00bb1\/1&Prime; tablet_width_inherit=\u00a0\u00bbdefault\u00a0\u00bb animation_type=\u00a0\u00bbdefault\u00a0\u00bb bg_image_animation=\u00a0\u00bbnone\u00a0\u00bb border_type=\u00a0\u00bbsimple\u00a0\u00bb column_border_width=\u00a0\u00bbnone\u00a0\u00bb column_border_style=\u00a0\u00bbsolid\u00a0\u00bb][vc_column_text]Une proposition l\u00e9gislative controvers\u00e9e (pr\u00e9sent\u00e9e dans la partie 4 du projet de loi C-4) qui menace la vie priv\u00e9e des \u00e9lecteurs a \u00e9t\u00e9 adopt\u00e9e par le S\u00e9nat, mais avec un amendement essentiel.<\/p>\n<p>La proposition l\u00e9gislative, qui accorderait aux partis politiques f\u00e9d\u00e9raux un blanc-seing en ce qui concerne leurs pratiques en mati\u00e8re de protection de la vie priv\u00e9e, a suivi un parcours sem\u00e9 d&#8217;emb\u00fbches au S\u00e9nat, qui a vot\u00e9 la nuit derni\u00e8re un amendement visant \u00e0 imposer une clause de temporisation de trois ans.<\/p>\n<p>La partie 4 du projet de loi C-4 soul\u00e8ve d&rsquo;importantes questions en mati\u00e8re de protection de la vie priv\u00e9e.<\/p>\n<p>Comme l&rsquo;<a href=\"https:\/\/sencanada.ca\/en\/committees\/LCJC\/Report\/150373\/45-1\">a conclu la<\/a> commission s\u00e9natoriale permanente des affaires juridiques et constitutionnelles (LCJC) lors de l&rsquo;examen de la proposition :<\/p>\n<p>\u00ab\u00a0La partie 4 est loin de r\u00e9pondre aux normes minimales requises pour prot\u00e9ger les int\u00e9r\u00eats individuels et nationaux des Canadiens, \u00e0 un moment o\u00f9 l&rsquo;exp\u00e9rience mondiale indique que ces int\u00e9r\u00eats sont de plus en plus menac\u00e9s\u00a0\u00bb.<\/p>\n<p>Le <a href=\"https:\/\/staging.ccla.org\/wp-content\/uploads\/2026\/02\/2026.02.12-CCLA.C4.LCJC-Opening.Statement.pdf\">t\u00e9moignage de l&rsquo;ACLC devant la commission s\u00e9natoriale<\/a> a soulign\u00e9 comment une approche de la campagne politique ax\u00e9e sur les donn\u00e9es constitue une grave menace pour la vie priv\u00e9e si elle n&rsquo;est pas contr\u00f4l\u00e9e. Une \u00e9tude men\u00e9e en 2020 aux \u00c9tats-Unis, par exemple, a r\u00e9v\u00e9l\u00e9 qu&rsquo;un parti politique avait <a href=\"https:\/\/www.washingtonpost.com\/technology\/2020\/10\/27\/political-campaign-data-targeting\/\">accumul\u00e9 plus de 3 000 points de donn\u00e9es sur chaque \u00e9lecteur<\/a> am\u00e9ricain. Au d\u00e9but de la m\u00eame ann\u00e9e, une fuite de donn\u00e9es a r\u00e9v\u00e9l\u00e9 un vaste ensemble de donn\u00e9es utilis\u00e9es par une campagne pour, entre autres, <a href=\"https:\/\/www.channel4.com\/news\/revealed-trump-campaign-strategy-to-deter-millions-of-black-americans-from-voting-in-2016\">\u00e9tablir le profil racial de plus de 3,5 millions d&rsquo;\u00e9lecteurs<\/a> afin de les bombarder de publicit\u00e9s sur les m\u00e9dias sociaux dans le but de les \u00ab\u00a0dissuader\u00a0\u00bb de voter.  <\/p>\n<p>Conscients des risques croissants pos\u00e9s par les messages politiques bas\u00e9s sur des donn\u00e9es, d&rsquo;autres juridictions, comme l&rsquo;Union europ\u00e9enne, vont d\u00e9j\u00e0 plus loin que les restrictions de base en mati\u00e8re de protection de la vie priv\u00e9e qui font encore d\u00e9faut au syst\u00e8me f\u00e9d\u00e9ral canadien. \u00c0 la fin de l&rsquo;ann\u00e9e 2025, un <a href=\"https:\/\/commission.europa.eu\/news-and-media\/news\/new-eu-rules-political-advertising-come-effect-2025-10-10_en\">r\u00e8glement europ\u00e9en sur la messagerie politique<\/a> est entr\u00e9 en vigueur, compl\u00e9tant les lois g\u00e9n\u00e9rales de l&rsquo;UE sur la protection de la vie priv\u00e9e en pr\u00e9voyant des <a href=\"https:\/\/www.hrw.org\/news\/2023\/06\/21\/eu-strong-rules-needed-political-advertising\">r\u00e8gles suppl\u00e9mentaires pour les partis politiques<\/a>. <\/p>\n<p>Mais la partie 4 du projet de loi C-4 ne met pas en place les r\u00e8gles les plus \u00e9l\u00e9mentaires et les plus internationalement accept\u00e9es en mati\u00e8re de protection de la vie priv\u00e9e au niveau f\u00e9d\u00e9ral. Toutes les pratiques en mati\u00e8re de donn\u00e9es sont permises, pour autant qu&rsquo;elles soient couvertes par les clauses g\u00e9n\u00e9rales de la politique de confidentialit\u00e9 de chaque parti politique. Les individus n&rsquo;auront pas la possibilit\u00e9 d&rsquo;acc\u00e9der aux donn\u00e9es d\u00e9tenues par les partis politiques et de les corriger.  <\/p>\n<p>La quatri\u00e8me partie ne s&rsquo;arr\u00eate pas \u00e0 l&rsquo;absence de toute limitation significative de la protection de la vie priv\u00e9e au niveau f\u00e9d\u00e9ral. Elle va plus loin. Elle vise \u00e0 priver les citoyens de leurs droits futurs &#8211; et historiques &#8211; en mati\u00e8re de protection de la vie priv\u00e9e en vertu de toute loi provinciale remontant \u00e0 l&rsquo;an 2000.  <\/p>\n<p>Cette tentative g\u00e9n\u00e9rale d&rsquo;immunit\u00e9 pour les violations pass\u00e9es et futures de la vie priv\u00e9e fait suite \u00e0 des d\u00e9cisions <a href=\"https:\/\/www.canlii.org\/en\/bc\/bcipc\/doc\/2022\/2022bcipc13\/2022bcipc13.html\">r\u00e9glementaires<\/a> et <a href=\"https:\/\/www.canlii.org\/en\/bc\/bcsc\/doc\/2024\/2024bcsc814\/2024bcsc814.html\">judiciaires<\/a> affirmant que les lois de la Colombie-Britannique sur la protection de la vie priv\u00e9e s&rsquo;appliquent aux partis politiques f\u00e9d\u00e9raux pour leurs activit\u00e9s dans les circonscriptions de la province (actuellement en cours d&rsquo;examen par la Cour d&rsquo;appel de la Colombie-Britannique).<\/p>\n<p>Malgr\u00e9 les graves implications de la partie 4, les amendements en question ont \u00e9t\u00e9 <a href=\"https:\/\/www.theglobeandmail.com\/politics\/article-advocates-question-tax-cut-bills-plan-to-shield-federal-parties-from\/\">enfouis dans un projet de loi omnibus portant principalement sur des questions financi\u00e8res<\/a>. Le gouvernement, avec le soutien des partis politiques d&rsquo;opposition (excluant notamment le <a href=\"https:\/\/www.hilltimes.com\/story\/2025\/06\/18\/piggybacking-changes-to-privacy-laws-has-nothing-to-do-with-affordability-say-critics-of-bill-c-4\/464408\/\">parti vert<\/a>), \u00e9tait pr\u00eat \u00e0 faire passer rapidement cette disposition d&rsquo;immunit\u00e9 dans les deux chambres du parlement avec un <a href=\"https:\/\/www.michaelgeist.ca\/2025\/11\/how-the-liberal-and-conservative-parties-have-quietly-colluded-to-undermine-the-privacy-rights-of-canadians\/\">minimum de d\u00e9bat<\/a>, cherchant m\u00eame \u00e0 <a href=\"https:\/\/sencanada.ca\/content\/sen\/chamber\/451\/journals\/pdf\/010jr_2025-06-12.pdf\">contourner l&rsquo;examen de la partie 4 par la commission l\u00e9gislative du S\u00e9nat<\/a> et, en cas d&rsquo;\u00e9chec, imposant des d\u00e9lais stricts sur la dur\u00e9e d&rsquo;\u00e9tude de la proposition. <\/p>\n<p>Lors de l&rsquo;examen final du projet de loi par le S\u00e9nat, de nombreux efforts ont \u00e9t\u00e9 d\u00e9ploy\u00e9s pour limiter les \u00e9l\u00e9ments les plus probl\u00e9matiques. La s\u00e9natrice Bernadette Cl\u00e9ment a propos\u00e9 que la partie 4 soit enti\u00e8rement supprim\u00e9e et, lorsque cette <a href=\"https:\/\/sencanada.ca\/en\/in-the-chamber\/votes\/details\/687194\/45-1\">proposition n&rsquo;a pas<\/a> \u00e9t\u00e9 adopt\u00e9e, la s\u00e9natrice Paula Simons a propos\u00e9 d&rsquo;ajouter un certain nombre de mesures de protection de la vie priv\u00e9e <a href=\"https:\/\/sencanada.ca\/en\/in-the-chamber\/votes\/details\/687208\/45-1\">directement dans le projet de loi<\/a>. Cette proposition n&rsquo;ayant pas non plus recueilli un soutien suffisant, une derni\u00e8re motion du s\u00e9nateur Pierre Dalphond <a href=\"https:\/\/sencanada.ca\/en\/in-the-chamber\/votes\/details\/687219\/45-1\">a \u00e9t\u00e9 adopt\u00e9e<\/a>, modifiant le projet de loi de mani\u00e8re \u00e0 ce que les changements soient annul\u00e9s trois ans apr\u00e8s son adoption.  <\/p>\n<p>Si elle est adopt\u00e9e avec cette clause de temporisation intacte, la partie 4 cherchera \u00e0 immuniser les partis politiques f\u00e9d\u00e9raux contre les lois sur la protection de la vie priv\u00e9e une fois que le projet de loi C-4 sera entr\u00e9 en vigueur, y compris pour les violations historiques remontant \u00e0 l&rsquo;an 2000.<\/p>\n<p>Toutefois, si le gouvernement f\u00e9d\u00e9ral ne parvient pas \u00e0 mettre en place des mesures compl\u00e8tes de protection de la vie priv\u00e9e dans un d\u00e9lai de trois ans, les lois provinciales s&rsquo;appliqueront \u00e0 nouveau en fonction de l&rsquo;\u00e9volution de la situation.<\/p>\n<p>La clause de temporisation complique \u00e9galement une affaire en cours devant la Cour d&rsquo;appel de la Colombie-Britannique. L&rsquo;appel porte sur la question de savoir si les lois de la Colombie-Britannique sur la protection de la vie priv\u00e9e peuvent \u00eatre concili\u00e9es constitutionnellement avec les dispositions de la <em>loi \u00e9lectorale du Canada<\/em> relatives \u00e0 la protection de la vie priv\u00e9e. <\/p>\n<p>Une juridiction inf\u00e9rieure a d\u00e9j\u00e0 estim\u00e9 qu&rsquo;il n&rsquo;y avait pas de conflit, car la <em>loi \u00e9lectorale du Canada (LEC<\/em> ) impose <a href=\"https:\/\/www.canlii.org\/en\/bc\/bcsc\/doc\/2024\/2024bcsc814\/2024bcsc814.html#par131\">peu d&rsquo;obligations significatives en mati\u00e8re de protection de la vie priv\u00e9e<\/a> et, par cons\u00e9quent, les partis politiques peuvent se conformer \u00e0 la fois \u00e0 la LEC et \u00e0 la loi britanno-colombienne sur la protection de la vie priv\u00e9e.<\/p>\n<p>La Cour d&rsquo;appel de la Colombie-Britannique devra maintenant d\u00e9cider si l&rsquo;ajout des dispositions relatives \u00e0 l&rsquo;immunit\u00e9 provinciale de la partie 4 et la clause de temporisation du S\u00e9nat modifient ce r\u00e9sultat.<\/p>\n<p>Ces deux dispositions, qui refl\u00e8tent l&rsquo;intention des deux chambres, montrent que le gouvernement f\u00e9d\u00e9ral peut supplanter les lois provinciales sur la protection de la vie priv\u00e9e, mais <a href=\"https:\/\/sencanada.ca\/en\/committees\/LCJC\/Report\/150373\/45-1\">uniquement en mettant en place un r\u00e9gime de protection de la vie priv\u00e9e vraiment solide et complet<\/a> pour les partis politiques au niveau f\u00e9d\u00e9ral.<\/p>\n<p>L&rsquo;amendement relatif \u00e0 la clause de temporisation a \u00e9t\u00e9 renvoy\u00e9 \u00e0 la Chambre des communes pour examen et, s&rsquo;il est rejet\u00e9, le S\u00e9nat devra d\u00e9cider s&rsquo;il insiste sur cet amendement.<\/p>\n<p>En fin de compte, les partis politiques ne peuvent pas \u00eatre laiss\u00e9s \u00e0 eux-m\u00eames pour d\u00e9terminer comment et dans quelle mesure ils collectent des donn\u00e9es \u00e0 caract\u00e8re personnel. Un cadre global est n\u00e9cessaire de toute urgence. L&rsquo;ACLC appelle les partis politiques f\u00e9d\u00e9raux \u00e0 accepter l&rsquo;amendement du S\u00e9nat et \u00e0 avancer rapidement vers l&rsquo;adoption de r\u00e8gles robustes en mati\u00e8re de protection de la vie priv\u00e9e au niveau f\u00e9d\u00e9ral.  <\/p>\n<p>Lisez les <a
